This is the reason you can not currently buy a Rail Runner locomotive. I have been told the locos have been made but can not be released until this issue is cleared up.

Quote: Metzger added that RailRunner N.A., a truck and rail transport company, is not giving up its position on the matter and said "the use of this mark continued to damage the business of RailRunner N.A."

Apparently passing the bar means having a pipe jammed in your head and 1/2 your brains sucked out.
Not even someone missing a couple of brain lobes is going to confuse a New Mexico commuter train with a New England trucking/freight company.

Squidbait - you don't understand lawyers! Icon_lol I work with plenty of lawyers for my job, and trust me - they nitpick everything. Literally, they may take a simple typo in a report and try and argue that it invalidates all your data. It's called catching someone on a technicality. If something isn't working to your favor, you find some little irrelevant detail and call it out, thereby questioning the validity of the whole case. The lawyers are simply being paid to do what the plaintiff wants them to do - win. And with the threat of people filing nitpicky lawsuits, you have to make sure all your bases are covered. As I understand it, the RailRunner is supported by public money. Knowing the attitude of some people towards public funding for anything, someone potentially could nitpick some little detail like the logo in order to sway public opinion against the whole project.

Sounds silly, but it happens all the time.
Oh I understand liars, er.... lawyers all right. It's all about money. And soaking your client and the other guy for all you can get.

Rather than tell the client it's a stupid suit with no chance of success, they'll push it as far as they can, bill as much as they can, tie up the courts with frivolous claims, and generally do more damage to their profession than good.

It's no wonder people rank lawyers somewhere between slime-mold and old sweat socks on the grand scale of life.

DITTO !!!!!!!!!!
Ok...let us look at this subjectivly.

This is the logo for RailRunner(one word) N.A. Which I'm guessing is on all their equipment.

This is the logo for the Rail Runner(seperate words) commuter line in New Mexico.

Oh...Yeah......Trademark infringement...Come on!
Also, the article didn't say if the models the hobby store was selling were Athearns. They've been offering Rail Runner (New Mexico) for years.
Oh god, seems the state of NM is the next UP!

I just heard that some slime-mold and some old sweat socks didn't like what you said and they want you to know that they are better than lawyers. They are also thinking about hiring a law firm to sue you for defamation of character. Icon_lol

Well , it is nice that they know who they are !!!! Icon_lol
Speaking of Rail Runner locomotives, does anyone make the MP36 engines that Rail Runner and FrontRunner actually uses. Athearn just made f59's painted in the right scheme but they only make them in HO. I painted an n f59 in the frontrunner colors to pull my train, but I would like to have the right locomotive.

True Line Trains has the MP36/MP40 coming. I cannot wait to get my hands on a Metrolink one.
