There are regulations and if a train doesn't operate over certain speeds or carry passengers these are serviceable tracks.

Guys,A lot of PRR's urban industrial branch lines had track very similar to that..The locomotive and freight cars would bob,sway and weave along their way..We thought nothing of it.

After watching the fireman walk across the cab of a swaying SW7 to get a light for his cigar,I guess I had a look of astonishment on my face because I was told by the firemen it was like riding a B6sb 0-6-0..
