That's one thing that we felt we couldn't take with us. Although the logo isn't trademarked, they did buy the domain, the name and everything that went with it, and we didn't want to get into any legal hassles. hence our new logo. We have also been hesitant to call ourselves "the Gauge". Although it isn't trademarked either, they could claim prior usage as a train forum and give us a hard time about its use, so although we are "the-gauge.net", we also go by, "Big Blue Train Forum". If anyone calls us, "The Gauge", I don't think we can do much about that, we've done what we need to do to protect the name.

What we suffered, at the hands of Peter, Zealot, and Crowdgather, is the prime reason why I feel the Federal Government, should never have "Bailed Out" any one!, Wall Street, Banks, Industries (read as C. E. O. ' s)

We're fortunate that we have this forum, and can "get away with" including "gauge" in the name.
I see no reason why our current logo cannot replace the old logo on "The-Gauge Railway", and no reason why the colors have to be changed.
I no longer have color ribbons for my ALPS printer, so I can't make color decals, except via ink jet, and that is not the greatest way to create decals.
We always learn far more from our own mistakes, than we will ever learn from another's advice.
The greatest place to live life, is on the sharp leading edge of a learning curve.
Lead me not into temptation.....I can find it myself!

Here's my take on it.
The old logo was original. If you remember, when the Gauge changed hands, and became Zealot, the old Gauge logo was no where to be seen..Anywhere!
When CG bought Zealot, the old logo was not revised, nor do I think CG even knew there was one, or cared. That put the old logo in limbo, and lost to time.
I remember when the UP tried to trademark all the railroads they gobbled up, because model manufacturers were still selling schemes in Western Pacific, Southern Pacific, C&NW, ect..ect..and the UP wanted royallties. The courts said that they couldn't trademark a logo, from something that no longer exsisted, and that they had to of trademarked the logos under UP ownership during the takeovers. They never did.
Thats why they have six SD70's painted in railroads they took over. If anything, the UP can only receive royalties if someone does a model of a SD70 in their "Heritage Fleet" schemes.
I think the old logo falls under that ruling.

And, believe it or not, Mikey and I were insistent that they keep it there and that we have what I call, "the-Gauge portal". Their contract with Peter includes the_guage.com domain, and name registrations. Here's an excerpt from their agreement:

And a black one. I did test print in black, before printing in white. Also, the white ribbon, has to have the "identifier sticker" from a black ribbon, to print. I never did figure out how to tell the printer "how" to print white.

OK...I didn't realize the logo was still in use.
I bookmarked the Forums Listing Page, and not the main one, so I assumed that the logo disappeared.
And you know what happens when you assume any thing. I guess I just made the three first letters of assume out of myself.

I use a link that takes me right to the "new posts" list, bypassing all that too. It's not the main Zealot page, but one we asked Pete to put in for us and one we had to find again to get CG to add. You are right though, I really don't think they cared too much about the Gauge name or logo, just that they have the rights and they'd scream "lawyer" if tried to use either.

BTW, just in case anyone is interested, Sanjay lists himself as "entrepreneur" on their web site. Popcornbeer

And also, I'm moving this thread to the mod zone, mainly because on Wed, it will be out in the open for all to see and I don't think we want to air our laundry out like that. Nope Nope
